LACTIS
These Terms are the agreement between you and Hypnox Technologies LLC ("Hypnox," "we") for the Lactis app and the lactis.app website. By using Lactis, you agree to them. This is a custom end-user license agreement that applies in place of Apple's standard Licensed Application EULA, while preserving every term Apple requires for App Store apps.
1 · Your license
We grant you a personal, non-exclusive, non-transferable license to use Lactis on Apple devices that you own or control, for personal, non-commercial use, as permitted by the App Store terms. You may not copy, modify, distribute, sell, reverse-engineer, or sublicense Lactis except where the law says we can't stop you.
2 · Your data
Everything you record in Lactis is yours. Hypnox runs no servers for your data. Everything lives on your devices and in your iCloud. How that works — including caregiver sharing and encryption — is described in our Privacy Policy, which is part of these Terms.
Because your data lives with you, backing it up is in your hands: keep iCloud sync on, or make exports. We can't recover data we never had.
3 · Subscriptions and purchases
The core of Lactis — all logging, timers, widgets, sharing with one caregiver, and your full history — is free. Two optional purchases unlock more:
Lactis Pro is an auto-renewable subscription billed at $4.99/month. New subscribers get a 7-day free trial; it converts to a paid monthly subscription unless cancelled at least 24 hours before the trial ends. Payment is charged to your Apple Account at confirmation of purchase; the subscription auto-renews unless turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to period end. Manage or cancel anytime in your Apple Account settings. Lactis Lifetime ($34.99) is a one-time purchase unlocking the same features permanently. See our Terms of Use and Privacy Policy.
Prices are shown in your local currency in the App Store and may vary by region. All billing, and all refunds, are handled by Apple under App Store rules — we can't issue refunds directly; request them at reportaproblem.apple.com. Purchases unlock features for the purchasing Apple Account. Cancelling stops future renewals; it doesn't retroactively refund the current period.
4 · Not medical advice
Lactis is an information and record-keeping tool, not a medical device, and nothing in it is medical advice. Sleep forecasts (including Sleep Tide), pattern insights, growth charts, reference schedules, and guidance cards are general, informational aids based on the data you enter and published reference sources. They are not a diagnosis, treatment, or a substitute for professional judgment.
Always consult your baby's doctor about health, feeding, sleep, growth, and medication questions, and before acting on anything Lactis shows you. If you think your baby may be having a medical emergency, call your local emergency number immediately — never rely on an app.
5 · Caregiver sharing
You control who can see and add to your baby's log. Caregivers join with their own Apple Account, and you can revoke access at any time. You're responsible for choosing whom you invite and for the accuracy of what's recorded in your household. Invite and handoff links grant access — treat them like keys and share them only with people you trust.
6 · Acceptable use
Don't use Lactis to break the law, to record information about a child you have no lawful right to record, to probe or disrupt the app or website, or to attempt to extract other people's data. We may terminate the license of anyone abusing the app or these Terms.
7 · Intellectual property
Lactis, its design, code, marks, and content are owned by Hypnox Technologies LLC and protected by law. Your data is not ours; our app is not yours. Feedback you send us can be used to improve Lactis without obligation to you.
8 · Apple services
Lactis relies on Apple services you enable — iCloud, CloudKit sharing, HealthKit, the App Store. Those are governed by your agreements with Apple, and their availability is Apple's, not ours. Apple is not responsible for Lactis, or for maintenance and support of it, and has no warranty obligation for it; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
As the App Store requires: you represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Hypnox — not Apple — is responsible for Lactis and its content, for addressing any claims relating to it (including product liability, regulatory, and consumer-protection claims), and for the investigation, defense, and settlement of any third-party claim that Lactis infringes intellectual-property rights.
9 · Disclaimers
Lactis is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that forecasts and insights will be accurate — babies are gloriously unpredictable, and so, sometimes, is software. If Lactis fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation for Lactis.
10 · Limitation of liability
To the fullest extent permitted by law, Hypnox will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of Lactis. Our total liability for any claim relating to Lactis is limited to the greater of the amount you paid us in the twelve months before the claim or fifty US dollars ($50). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you; in those places our liability is limited to the smallest amount the law allows.
11 · Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Before filing any claim, contact [email protected] — most issues can be fixed faster than a filing. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Delaware, and both sides consent to their jurisdiction.
12 · Termination
You can stop using Lactis at any time — your data remains yours to export or delete. We may suspend or terminate the license for breach of these Terms. Sections that by their nature should survive (your data ownership, disclaimers, liability limits, governing law) survive termination.
13 · Changes to these Terms
If we update these Terms, we'll change the effective date above and note meaningful changes in the app's release notes. Continuing to use Lactis after a change means you accept the updated Terms.
